This document (“Terms of Use”) governs your use of the website located at bhs-va.com (the “Site”), operated by Battlefield Home Services, LLC (“BHS,” “we,” “us,” or “our”). By accessing or using the Site, you (“you” or “user”) agree to be bound by these Terms of Use. If you do not agree, do not use the Site.
These Terms of Use govern the Site only. They do not govern the terms of any renovation project, which are set out separately in a signed contract between BHS and the homeowner.
1. Acceptance of Terms
By accessing or using the Site, including submitting a form, requesting a Free Onsite Assessment, or otherwise providing information through the Site, you agree to be bound by these Terms of Use as they may be updated from time to time. If you do not agree to these Terms of Use, do not access or use the Site.
2. Purpose of the Site
The Site provides information about BHS’s kitchen and bathroom remodeling services, examples of past projects, and a means to request a Free Onsite Assessment. Content on the Site, including project photographs, pricing ranges, service area information, and service descriptions, is provided for general informational purposes only. It does not constitute a binding offer, quote, or guarantee of price, timeline, or availability for any specific project. Binding terms for any renovation project are established only through a separate signed contract between BHS and the homeowner.
3. Eligibility
The Site is intended for homeowners and prospective customers located within, or considering a project within, BHS’s service area of Virginia Beach, Chesapeake, Norfolk, Portsmouth, Suffolk, Hampton, and Newport News, Virginia. By using the Site, you represent that you are at least 18 years of age and capable of entering into a binding agreement.
4. Intellectual Property
All content on the Site, including text, project photographs, before-and-after images, graphics, logos, and the BHS brand name and marks, is the property of Battlefield Home Services, LLC or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may view and share Site content for personal, non-commercial purposes. You may not reproduce, distribute, modify, republish, or use Site content for any commercial purpose without our prior written consent.
Before-and-after photographs and project images displayed on the Site may depict actual BHS projects. Customer testimonials and reviews are used with permission and reflect the individual experiences described; results, timelines, and pricing described in any testimonial are specific to that project and are not a guarantee of results for any other project.
5. Form Submissions and Privacy
Information you submit through Site forms, including contact forms, chat, or Free Onsite Assessment requests, is used to respond to your inquiry and administer your requested services.
Submitting a form or providing a mobile phone number does not, by itself, constitute consent to receive recurring marketing text messages. SMS consent is collected separately as described in Section 7.
6. Free Onsite Assessment Requests
Requesting a Free Onsite Assessment through the Site is a request only and does not guarantee that BHS will schedule or perform an assessment. The Free Onsite Assessment is intended for homeowners with an active kitchen or bathroom renovation project consistent with BHS’s scope of services, service area, and typical project size. BHS reserves the right to decline, reschedule, or redirect a request that does not meet these criteria, and to request additional project information before scheduling.
7. Text Messaging (SMS) Communications
If you provide your mobile phone number through an eligible Battlefield Home Services website form and voluntarily check the separate SMS consent checkbox, you agree to receive recurring automated text messages from Battlefield Home Services, LLC regarding your renovation inquiry, appointment confirmations and reminders, quote follow-up, service or project updates.
Message frequency varies, up to 6 messages per month. Message and data rates may apply.
Consent to receive text messages is not a condition of purchasing any goods or services from Battlefield Home Services. Providing a mobile phone number by itself does not constitute consent to receive recurring SMS messages.
You may opt out at any time by replying STOP to any message. You may receive one final message confirming your opt-out request. Reply HELP for assistance.
Battlefield Home Services does not sell, rent, share, or disclose mobile phone numbers, SMS opt-in data, or SMS consent to third parties or affiliates for their own marketing or promotional purposes. Mobile phone numbers, SMS opt-in data, and SMS consent will not be transferred to any third party or affiliate for its own marketing or promotional use.
Service providers that assist Battlefield Home Services with transmitting or administering text messages may process mobile information only on behalf of Battlefield Home Services and only as necessary to provide those services. They may not use that information for their own marketing or promotional purposes.
SMS consent applies only to communications from Battlefield Home Services for the purposes described above and is not transferable to another business.

8. Prohibited Use
You agree not to use the Site to: violate any applicable law or regulation; submit false or misleading information; attempt to gain unauthorized access to the Site or its underlying systems; interfere with the Site’s operation or security; or scrape, harvest, or reproduce Site content for use in a competing business.
9. Third-Party Links
The Site may contain links to third-party websites, including financing partners (Synchrony, Hearth) and review platforms (such as Google). These links are provided for convenience only. BHS does not control, endorse, or assume responsibility for the content, terms, or privacy practices of any third-party site, and your use of any third-party site is at your own risk and subject to that site’s own terms.
10. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BHS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PRICING, AVAILABILITY, OR PROJECT-RELATED INFORMATION DISPLAYED ON THE SITE IS CURRENT OR ACCURATE FOR ANY SPECIFIC PROJECT.
11. Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, BHS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF BHS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BHS’S TOTAL LIABILITY ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
12. Indemnification
You agree to indemnify and hold harmless Battlefield Home Services, LLC, its owners, employees, and agents from any claim, loss, or damage, including reasonable attorneys’ fees, arising from your misuse of the Site or violation of these Terms of Use.
13. Changes to These Terms
Battlefield Home Services may update these Terms of Use from time to time to reflect changes in our services, the Site, or applicable law. Updates are effective when posted to the Site, and the “Effective Date” above will be revised accordingly. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
14. Governing Law
These Terms of Use are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law principles.
